Mallory McKnight Fuller is senior counsel and Director of E-Discovery. She joined the firm in 2014 and leads a multidisciplinary e-discovery team. In addition to managing the review and production process, Mallory’s experience in electronic discovery and electronically stored information includes development of discovery protocols in federal and state courts, including negotiation of search terms with opposing counsel. She manages the review of general and matter-specific documents for ongoing oil and gas litigation, energy litigation, environmental litigation, construction litigation, and other matters.

Mallory routinely prepares records custodians and corporate representatives for depositions regarding e-discovery efforts, including implementing and fulfilling obligations pursuant to court-ordered compliance efforts. She also assists corporate clients with custodian identification, supervising and participating in custodian interviews, overseeing forensic collection, and managing and designing technology assisted reviews, including predictive coding and continuous active learning.

  • Develops and implements e-discovery strategies tailored to complex litigation and regulatory investigations, ensuring defensible and efficient workflows.
  • Drafts and negotiates detailed ESI protocols with opposing counsel to streamline discovery processes and reduce disputes.
  • Manages large-scale document review projects, including identifying, preserving, collecting, processing, and analyzing ESI.
  • Assists clients in resolving e-discovery disputes, including meet-and-confer sessions and motions related to ESI production.
  • Leverages predictive coding and AI-driven review techniques to prioritize and expedite document analysis.
  • Proficient in using industry-leading platforms such as Nuix and Relativity to perform data culling, keyword searches, and privilege reviews.
  • Designs and executes cost-effective e-discovery solutions, saving clients significant monetary amounts through technology-assisted review and efficient workflows.
  • Drafts legal hold notices for clients for preservation of records relevant to ongoing litigation.
  • Interviews employees regarding records in their possession responsive to legal hold notices.
  • Drafts search terms and syntax to identify potentially responsive documents in context of ongoing litigation.
  • Advises clients on proper scope of document productions in context of ongoing litigation.
