Deborah J. Juneau

Deborah Juneau is a partner in the Baton Rouge office of Kean Miller. She joined the firm in 1999 and practices in the litigation, healthcare regulatory, medical malpractice defense, and appellate groups.

Deborah represents a variety of clients including energy and petrochemical companies, local businesses, and health care providers, including physicians, physician groups, social workers and mental health rehabilitation programs, nursing homes, nurses, nurse practitioners, physician's assistants, and other health care providers. In the healthcare field, she assists health care providers with litigation and trials, health law administrative matters, regulatory issues, Stark and anti-kickback matters, qui tam cases, fraud and abuse claims, defense of Medicare and Medicaid audits and recoupment actions, defense of debt recovery actions by U.S. Department of Treasury, and reimbursement, exclusion and reinstatement challenges. She has experience before the Louisiana State Board of Medical Examiners, Louisiana Board of Nursing, Louisiana State Board of Social Work Examiners, and other licensing boards, as well as before credentialing agencies such as managed care organizations, hospitals, and insurance companies.  Deborah also represents clients in commercial and business litigation and insurance defense.

Representative Experience

  • Litigation and Trial
    • Served as Trial Attorney/Counsel in defending high-profile, multiple-plaintiff lawsuits arising out of an explosion and fire at a major Louisiana chemical manufacturing facility. The Kean Miller emergency response and trial teams assisted our client in official notifications, evidence preservation, incident investigation, interaction with state and federal regulatory authorities, litigation management, and complex mass joinder and personal injury trial defense in multiple venues, including taking several cases to verdict.
    • Representation of numerous commercial and industrial clients in personal injury,  premises liability, and products liability  litigation and contractual indemnity actions
    • Successfully defended dismissal of case against a major chemical company on grounds of abandonment by winning a landmark Louisiana Supreme Court decision
    • Successfully defended dismissal of case against a major fertilizer manufacturing company brought by a general contractor under the Private Works Act through all appeals, including to the Louisiana Supreme Court

  • Appellate
    • Obtained favorable Louisiana Supreme Court decision upholding dismissal of case against a major chemical company on grounds of abandonment
    • Obtained favorable Louisiana Supreme Court decision upholding dismissal of Private Works Act case against a major fertilizer manufacturing company
    • Defend multiple trial court decisions in favor of clients through appeals in both state and federal appellate courts
  • Healthcare Regulatory
    • Assist physicians in matters before the United States Drug Enforcement Agency (DEA)
    • Representation of numerous health care providers in defense of qui tam and False Claims Act cases
    • Representation of numerous health care providers in defense of Medicare and Medicaid post-payment audits and in administrative proceedings for recoupment of Medicare and Medicaid payments with significant reductions in recoupment amounts
    • Representation of physicians and other healthcare providers in transactional matters that involve regulatory compliance questions under the Stark law and state and federal Anti-Kickback statutes
    • Representation of clients in settlement of claims pertaining to potential Stark Law violations through CMS’ voluntary Self-Disclosure Reporting Protocol 
    • Representation of physicians, social workers, nurses, personal care service providers, and other health care providers in professional licensing board matters, and hospital and insurance credentialing matters, and Louisiana Department of Health licensing matters

Education

Deborah earned her B.S. from Louisiana State University in 1976. She earned her J.D. from the LSU Law Center in 1999 where she was a member of the Order of the Coif and the Louisiana Law Review. Deborah is a member of the LSU Law Center Hall of Fame.
