Devin Ricci

Devin Ricci is a partner and registered patent attorney who works with companies, universities, and other organizations to develop, protect, manage, commercialize, and enforce intellectual property. With a technical background in biochemistry, his practice spans patents, trademarks, trade dress, copyrights, trade secrets, and related technology and brand matters. To date, Devin has worked on more than 300 patent matters and more than 800 federal trademark matters.

His practice spans the full lifecycle of intellectual property. Devin works with clients from the early stages of research, product development, and brand selection through portfolio development, commercialization, enforcement, and litigation. This breadth allows him to evaluate individual patent, trademark, and litigation issues in the context of a client’s broader portfolio, competitive position, and business objectives.

Devin coordinates matters across Kean Miller’s multidisciplinary intellectual property team, drawing on lawyers with technical backgrounds in aerospace, biochemistry, chemistry, computer science, electrical engineering, mechanical engineering, and ocean engineering to bring relevant technical experience to matters involving prosecution, strategic counseling, transactions, and litigation.

Intellectual Property Disputes and Enforcement

Devin represents clients in complex intellectual property disputes and has served as lead counsel in matters involving patent infringement, trademark and trade dress infringement, trade secret misappropriation, copyright infringement, false endorsement, and related unfair competition and technology claims. He has represented both plaintiffs and defendants in federal courts and clients in contested proceedings before the Trademark Trial and Appeal Board.

His litigation experience also informs his portfolio and counseling work. Devin advises clients on enforcement strategy, infringement risk, competitor activity, potential design-around options, and the practical consequences of decisions made during prosecution and portfolio development. He works with clients to evaluate negotiated resolutions, licensing arrangements, and other approaches when litigation is not the best business solution.

Intellectual Property Strategy and Portfolio Development

Devin advises clients on building and managing patent and trademark portfolios that support their products, technologies, brands, and broader business strategies. His patent practice began with hands-on drafting and prosecution of patent applications and has evolved to include supervision of prosecution, portfolio development, strategic counseling, and coordination of domestic and international patent matters.

His work includes patentability and freedom-to-operate analyses; non-infringement and validity opinions; competitor and portfolio analysis; design-around counseling; and U.S. and international patent strategy. Devin works closely with engineers, scientists, executives, in-house counsel, and members of Kean Miller’s interdisciplinary patent team to identify protectable technology, evaluate third-party rights, and develop portfolios aligned with commercial objectives.

His patent and trademark work has involved intellectual property protection across more than 40 countries and jurisdictions, including coordination of international patent protection through the Patent Cooperation Treaty and trademark protection through international and regional filing systems.

Trademark and Brand Protection

Trademark and brand protection are central to Devin’s practice. He develops and manages domestic and international trademark portfolios, evaluates new brands and products, addresses third-party rights, negotiates consent and coexistence arrangements, and develops enforcement strategies.

His trademark practice spans clearance, prosecution, portfolio management, licensing, enforcement, and contested matters. Devin has represented clients in opposition and cancellation proceedings before the Trademark Trial and Appeal Board, federal and state trademark litigation, trade dress disputes, and matters involving false endorsement and related claims.

Devin approaches trademark portfolios as business assets rather than collections of registrations. This includes considering how clearance, filing strategy, enforcement, licensing, acquisitions, divestitures, and changes in a client’s business affect the strength and value of the overall portfolio.

Intellectual Property Transactions and Commercialization

Devin advises clients on transactions involving intellectual property and technology, including licensing arrangements, technology transfers, assignments and acquisitions of intellectual property rights, and IP issues arising in mergers, acquisitions, divestitures, and other strategic transactions.

He works with business leaders, in-house counsel, and Kean Miller’s transactional attorneys to evaluate intellectual property assets, identify ownership and protection issues, conduct IP due diligence, and structure transactions to ensure that intellectual property rights support the client’s broader commercial objectives.
