As an experienced litigator, Lauren Guichard Hoskin resolves complex disputes involving all aspects of both the energy and marine industry, as well as all types of commercial litigation and general business claims. She possesses considerable skill in litigating, arbitrating, defending, and prosecuting a wide variety of admiralty and oil and gas casualty, personal injury, property damage, and breach of contract claims.

Throughout her practice, Lauren has developed extensive litigation experience and has successfully represented and defended numerous clients, including oil and gas operators (offshore, midstream and onshore), local maritime businesses, vessel owners, platform owners, shipyards, Fortune 500 energy companies, and their service providers and contractors in litigation and alternative dispute resolution in both state and federal courts. She has successfully handled and resolved lawsuits involving maritime personal injury claims, oil and gas casualty and property damage claims, drilling accidents, well blowouts, lost royalty claims, imprudent operator and oil and gas reservoir damage claims, cargo damage, ship allisions and collisions, vessel groundings, pipeline damage, vessel damage, platform damage, barge damage, and breach of contract disputes, including but not limited to, joint operating agreements, master service agreements, and numerous other oil and gas contracts.

In addition, Lauren advises her clients on all aspects of Jones Act claims, General Maritime Law claims, and claims involving onshore/offshore oil and gas exploration. She also regularly provides advice on state and federal statutes and regulations, including the Outer Continental Shelf Lands Act, the Longshore and Harbor Workers’ Compensation Act, Louisiana Oilfield Anti-Indemnity Act, the Texas Anti-Indemnity Act, and other related regulations.

Representative Experience

Litigation

  • Successfully defended and obtained a favorable verdict for client, an oil and gas exploration and operating company, in a multi-million-dollar downhole drilling three-week jury trial in a Louisiana state court, involving imprudent operator and reservoir damage claims.
  • Successfully defended a marine construction contractor in federal bench trial on claims of breach of maritime contract.
  • Trial experience representing stevedoring company in litigation and jury trial against personal injury claims associated with an incident at the Port of Baton Rouge.
  • Representation of towboat and barge owners in defense of property damage and personal injury claims under the Jones Act and the General Maritime Law.
  • Representation of drilling companies and oil companies in lawsuits filed by offshore workers based on the Jones Act, General Maritime Law, Louisiana state law, and the Longshore and Harbor Workers' Compensation Act.
  • Representation of offshore oil and gas platforms, drilling rigs, land-based well owners, drillers, and operators in the defense of personal injury claims and in the defense and prosecution of property damage and other claims associated with well blowouts, explosions, platform damage, royalty claims, operating disputes, reservoir damage, vessel allisions, diving incidents, personnel basket transfers, and other issues, such as the analysis of defense and indemnity and other issues under relevant contracts.
  • Representation of clients in matters involving the Outer Continental Shelf Lands Act, including application of its choice of law provisions.
  • Representation of marine and energy companies, including docking and operating facilities on the Mississippi River and other waterways involving significant catastrophes resulting from pipeline ruptures, barge breakaways, vessel collisions, and vessel allisions.
  • Representation of clients in matters involving the potential application of the Louisiana Oilfield Anti-Indemnity Act, and the Texas Anti-Indemnity Act.
  • Representation of clients in matters involving defense and indemnity issues in drilling and operations contracts, including master service contracts.
  • Representation of government contractor in litigation surrounding multi-million-dollar oil spill response efforts.
  • Representation of a national commercial charterer in disputes arising out of contracts of affreightment, including demurrage disputes and force majeure defenses, as well as the negotiation, mediation, and arbitration of contractual disputes.
  • Representation of oil and gas exploration companies against claims for breach of the "prudent operator" standard and reservoir loss and damage claims.


Transactional

  • Experience in drafting, reviewing, and negotiating Master Service Agreements, Professional Services Agreements, Drilling Contracts, subcontracts, Charter Agreements, and other vendor contracts related to the oilfield, maritime, environment, and construction industries.
  • Experience in drafting, reviewing, and negotiating construction contracts including large marine construction contracts and commercial and residential construction contracts.
