ERISA and Employee Benefits

Kean Miller assists clients in the development, design, and implementation of employee benefit plans, and in the administrative compliance for those plans. Led by Bob Schmidt, our ERISA and Employee Benefits team provides employers creative and innovative advice with respect to ERISA issues, qualified plans, plan reporting, fiduciary compliance, and negotiations with and approvals from the Internal Revenue Service.

Our experience includes pension, profit sharing, and health and welfare plans, employee stock ownership plans, deferred compensation arrangements, executive employment agreements and stock option contracts, 403(b) plans, 457 plans, and other plans for governmental employers and non-profits. We have worked on plans for publicly-traded and privately held companies. We assist clients in Internal Revenue Code compliance, and advise employers and executives in connection with ERISA challenges. On the administrative side, we counsel clients on plan administration, maintenance, termination, and fiduciary duties. We help clients with required reporting for plans, as well as disclosure to participants.

We have helped clients obtain favorable determination letters for their plans, and have obtained favorable resolution of plan compliance problems, including voluntary corrections and relief from penalties and excise taxes. We regularly represent clients who are examined by the IRS and/or investigated by the Department of Labor.
